Types of Bankruptcy

Chapter 7

Chapter 7 bankruptcy is filed by individuals. Also called "liquidation" bankruptcy, it consists of selling off the individual's assets to pay their debts.

Chapter 13

Chapter 13 is for individuals who wish to construct a "workout" or payment plan to repay their creditors.

Chapter 11

Chapter 11 also involves creating a payment plan to repay creditors, but is tailored for business rather than individual use

Receivership

While not a type of bankruptcy per se, receivership does resemble bankruptcy in a number of ways. When a business goes into receivership, the bankruptcy court appoints a neutral party to liquidate the business or keep it running, whichever is in the creditors' best interests. Until the receivership is at an end, the neutral party is required to give regular reports to the court.
