Chapter 7, 13 And 11 Bankruptcies

Chapter 7: Chapter 7 bankruptcy is filed by individuals. Also called “liquidation” bankruptcy, it consists of selling off an individual’s nonexempt assets to pay some of his or her debts. Our Providence-based Chapter 7 attorneys assert the interests of creditors throughout the state in Chapter 7 bankruptcy proceedings.

Chapter 13: Chapter 13 bankruptcy is for individuals who wish to construct a “workout” or payment plan to repay their creditors. Creditors are paid by a bankruptcy trustee each month in accordance with a three- to five-year repayment plan that is approved by the court.

Chapter 11: Chapter 11 bankruptcy also involves creating a payment plan to repay creditors, but is tailored for business rather than individual use.

Receiverships

While not a type of bankruptcy per se, receivership does resemble bankruptcy in a number of ways. When a business goes into receivership, the state court appoints a neutral party to liquidate the business or keep it running. Until the receivership is at an end, the receiver is required to give regular reports to the court. We assist creditors in taking prompt action to assert their claims in receiverships.

Bankruptcy Services Focused On Creditors’ Rights

We represent creditors in all types of bankruptcy and receivership cases. We serve creditors whose debtors have gone into bankruptcy or receivership by filing a claim against the estate and appearing at the bankruptcy hearing. We represent many auto dealers who wish to repossess or replevin vehicles.
